These Terms of Service ("Terms") govern your use of the website at liftly.co and the related services (the "Service") provided by Liftly LLC, a New Mexico limited liability company ("Liftly", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Liftly provides a subscription service that grows your Instagram following through targeted promotion campaigns and curated audience matching. We do not access your Instagram account, request your password, or operate any automation against your profile.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract. The Service is intended for use in connection with Instagram accounts that you own or are authorized to operate.
3. Subscriptions and Billing
- Subscriptions are billed monthly or annually in advance, depending on the plan you select.
- Subscriptions automatically renew at the end of each term unless cancelled before the renewal date.
- You may cancel at any time through your account dashboard or by emailing hello@liftly.co.
- Cancellation stops future billing. It does not entitle you to a refund of fees already paid except as described in our Refund Policy.
4. Refund Policy
We offer a seven-day money-back guarantee on every plan, as described in our Refund Policy. Refund requests outside that window are evaluated case by case.
5. Acceptable Use
You agree not to use the Service to promote content that is illegal, deceptive, defamatory, infringing, or that violates Instagram's terms or applicable law. We reserve the right to refuse service or terminate any account at our discretion.
6. No Affiliation with Instagram
Liftly is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. Instagram is a trademark of Meta Platforms, Inc.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. While we work to deliver consistent results, follower counts, engagement, and any other metric depend on factors outside of our control, including platform algorithm changes, content quality, and your existing audience.
8. Limitation of Liability
To the maximum extent permitted by law, Liftly's total liability arising out of or related to the Service is limited to the amount you have paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
9. Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws provisions. Any dispute arising out of these Terms shall be brought exclusively in the state or federal courts located in New Mexico.
10. Changes
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
